Why insurance? For the helicopter ride.

It is mandatory for all our customers to purchase a travel insurance that covers medical emergencies (including air ambulance in events of accidents or illness) and trip cancellation due to technical or logistics reasons, 'force majeure', or other unforeseen circumstances.

We insist on sending us the details of the purchased travel insurance no later than 15 days prior to the start of the trip - a scanned copy of the insurance policy together with 24/7 emergency contact number and the details of the emergency contact person.

If no proof of travel insurance is provided to the Company latest the day of departure, we reserve the right to cancel the booking of the Customer with no right to refund.

Non-riders

Everything is better when shared. Except STDs. So if you’d like to bring a non-rider companion, the cost is around 1300€, depending on the number of companions that have registered. They will travel in the support vehicle that will meet you in all the pre-arranged locations, lunches, camping spots, and all the other activities we got planned – diving, balloon flight, snorkelling, boat trip, etc. We’ll be in radio communication with the support vehicle so we can arrange meeting points on the fly, if possible.

Equipment

We believe in protecting yourself as much as possible without compromising the pleasure of riding. Considering we’ll travell mostly during the day, on dusty tracks and sometimes under quite harsh temperatures, you should bring a well ventilated set of protection gear: helmet, jacket, pants, gloves and boots. Especially an enduro helmet for the added ventilation. The internal hydration pack for water should be your permanent companion - make no compromises here.

RECOMMENDATIONS
Clothing: considering the weather, you’ll be happier with quick-dry microfiber t-shirts, underwear and travel towels.
Health: UV protection suncream factor 30 or higher, depending on your skin sensitivity. Any medication you might need.
Other: A good headlamp is a good addition to any travel endeavour.
Batteries for your devices. Lots of them. Electricity penetration is not Socotra’s strong point, and we can only charge so many devices on the generator and support vehicle’s power outlet.

TERMS AND CONDITIONS

1. LEGAL PARTIES

  1. This is a contract between This is Alive SRLD, company registration number J23/2404/20.08.2014, fiscal code number 33496947, with registered office address in Str. Drum Chitila Nr.25, Jud. Ilfov, Romania – mentioned in the hereinafter Terms and Conditions as the “Company” or “we”. Below Terms and Conditions apply to all expeditions mentioned in all our brochures and website.
  2. The “Customer” or “you” referring to the person who has expressed the wish and the will to participate to our expeditions.
  3. In the event where one person makes the booking for several other people, the below Terms and Conditions will need to be signed individually by all partcipants to the tour, indifferent of the person who makes the booking or performs the payment.

2. THE CONTRACT

  1. The Contract is formed of: 1) below Terms and Conditions, 2) sign up form, 3) the itinerary as mentioned in the Rider’s booklet received upon sign up.
  2. In the case of any discrepancies, below Terms and Conditions will prevail.
  3. The Company shall deliver services to the Customer based on the tour selected by the Customer [Enduro Expedition – Socotra] or commonly agreed with the Customer at a later stage, at the price of 3350€.
  4. The following services are included in the price of the tour selected: motorbike rental for the entire duration of the trip, gas, all accomodation in twin bed room that will be shared with another companion (extra charge of 15€/passenger/night if Customer decides to opt for a private room), all meals, all land transportation, bottled water, airport and local transfers, all fees related to entrances to national parks, all camping gear except sleeping bags, local guide, ballon ride, sandboarding, diving (1 session) and boat trip (1 session).
  5. The price excludes: international and domestic flights, any airport taxes, travel insurance, personal expenses, visa fees, any items not mentioned above or in section 2.4.

3. METHOD OF PAYMENT

  1. All payments shall be performed through international bank transfer to the Company’s bank account number RO77INGB0000999904516912, SWIFT Code INGBROBU.
  2. The Customer will ensure that the Company will receive the deposit and the remaing balance of the tour after all bank charges related to the transaction have been paid to the bank.

4. DEPOSIT

  1. A deposit of 500€ is required for booking to become effective.
  2. Your booking will be cancelled if the remaining balance is not paid prior to the above-mentioned date. In such case, the Company will retain the entirety of the deposit.
  3. The contract between the Company and the Customer will take effect, being binding and final between the parties, the moment the Customer has received the notification of acceptance of the deposit issued by the Company.
  4. The Company reserves the right to return the deposit to the Customer and refuse the Customer’s application at any time, including after the beginning of the trip.

5. BALANCE of PAYMENT

  1. The full balance is expected to be paid, no later than 40 days before the start of the tour.
  2. The Customer will pay the entire balance of the tour price (including any visa costs if applicable) if the booking is made less than 40 days before the start date of the trip.
  3. If the balance of payment is not received 40 days prior to departure, the Company reserves the right to cancel the booking and retain the deposit.

6. Cancellation by the CUSTOMER

  1. Our primary income comes from the fees charged for the tour and contributes to the overall cost of equipment, running costs, staffing, administration, etc., and that the Company’s largest expenses are prior to the actual date of departure. As a result, cancellations of the trip made by the Customer need to be in writing by the person who booked the tour and fall under the following rules:
  2. Cancellation prior to 60 days to the trip start: You are entitled to cancel the trip and obtain a refund of the original deposit.
  3. If the cancellation occurs at least 60 days prior to the trip start, 50% of the original deposit will be refunded, or up to 100% up to the Company’s discretion.
  4. Cancellation within less than 60 days prior to the start of the trip:
    1. between 60 days and 30 days: the deposit will be lost
    2. between 30 days and 15 days: the deposit will be lost together with 30% of the tour cost
    3. less than 15 days: the deposit will be lost together with 100% of the tour cost.
  5. If the Customer decides to cancel the trip after the departure date, no refund for the unused portions of the trip will be given.
  6. If the Customer decides to make any changes in the original itinerary, these will fall entirely under the Customer’s expenses and liability.

7. Cancellation by the COMPANY

  1. The Company reserves the right to cancel the tour booked by the Customer due to any unforeseen situations such as weather conditions, civil or political unrest or any other circumstances beyond our control, or if the minimum number of participants has not been reached (minimum 5 participants per tour).
  2. In above cases of unforeseen situations, we will inform the participants as soon as possible and refund any fees that have been charged that can be retrieved.
  3. If the minimum number of participants of the tour has not been reached, the Company will inform the Customer no later than 30 days prior to departure and will proceed with offering alternative tours to an equivalent or lesser price.
  4. If the Customer doesn’t agree with the proposed offer, the Company will refund all money received from the Customer.
  5. The Company takes no responsibility of returning the cost of the trip in cases where the Customer cannot travel due to issues related to health, visas, or other personal matters. The arrangement for medical vaccinations, passport procedures and visas prior to the initiation of the tour falls entirely under the responsibility of the Customer.
  6. The Company is not held responsible for any personal expenses incurred by the Customer for the preparation of the trip. For this, we strongly recommend our clients to purchase a trip cancellation insurance from an insurance company covering for the any additional loses which are not included in the Company’s cancellation policy.

8. Transfer of the booking by the Customer

  1. The Customer has the right to transfer the booking made to another person who satisfies all the conditions applicable to the trip, no less than 30 days prior to the departure date, with no additional costs.
  2. If less than 30 days a late, a transferee fee of 100€ will be applied.
  3. The Transferee agrees to be bound with the current Terms and Conditions and pay, if the case, the additional transferee fee.

9. Safety

  1. The Customer is knowledgeable of the geographical and political circumstances, as well as physical requirements of the trip, and assumes the risks involved and is adequately insured to travel. The Company accepts no liability for the Customer’s decision to travel to this location.

10. Changes in the itinerary made by the Company

  1. The Customer understands that the preparations for the trip take place months in advance. Special situations may occur between the time of the booking and actual start of the trip. In the event of such cases, the Company reserves the right to make reasonable adjustments to the itinerary – changes which the Customer should accept and agree with.
  2. In cases where the Company becomes aware of situations of “force majeure” prior to the departure date, the Company will inform as soon as possible the Customer using the contact details filled in the application form and the Customer will be fully refunded.
  3. All published itineraries should be considered as indicative only for what the tour aims to achieve and they don’t constitute any contractual obligation on the part of the Company.
  4. The Company reserves the right to alter the itinerary after the departure date, if the Company considers it is in the interest of the Customer.
  5. If the Customer refuses to follow the changed itinerary, the Customer will need to provide in writing the reason of refusal and sign off from the trip. In such cases, the Customer will not be refunded for any unused facilities included in the tour.
  6. The Customer accepts and agrees that due to the nature of the endeavor, a certain degree of flexibility will be required.
  7. The leader of the group retains the right to alter the itinerary basis on various reasons: weather, local conditions, political situations, security of the team etc. In these extraordinary cases, the Company will not pay any refunds.

11. The Company and Customer’s responsibility

  1. The Company’s responsibility will start the moment when the Customer will meet with the group at the designated starting point.
  2. The Company is not responsible for any expenses incurred by the Customer until arriving to the starting point.
  3. The Customer accepts and agrees that, besides the motorcycles offered as part of the tour, a 4X4 car will act as a secondary mode of transportation in cases where:
    1. The motorcyle driven by the customer cannot be repaired on the spot by the Company’s mechanic and the back-up motorcycle is not available within reasonable timing to allow the Customer to continue the trip for that day. In such case, if:
      1. the motorbike needs repair for reasons independent of the Customer’s riding manners, the Customer will receive a discount of 25% of the daily price for that day.
      2. the motorbike needs repair for reasons dependent of the Customer’s riding manners, the Customer will not receive any discounts.
    2. The Company, for different reasons, is not in a position of offering a back-up motorcycle of the same kind to allow the Customer to continue the trip for the remaining duration of the expedition. In such case, the Customer will receive a discount of 30% of the daily price for all remaining days of the expedition.
  4. Through this contract, the Customer accepts and fully understands that the risks involved in travelling to such remote locations may involve potential situations of force majeure, political and social unrests, terrorism, war and forces of natures which are out of Company’s control. The Customer assumes full responsibility for the above, and in no circumstances, the Company can be held liable for such events and the Customer decision to book the expedition.
  5. The Customer accepts all risks associated with driving the motorcycles during the entire duration of trip, knowing that medical support and evacuation may not be available or are likely to take a considerable amount of time due to the remote nature of the location.
  6. The Company is not liable for any changes or disturbances in the natural scheme of the itinerary due to causes not generated by the Company’s employees, or generated by Customer’s fault, by any other participant to the trip, or by any third party not engaged in the organization of the expedition.

12. Medical condition of the customer

  1. You are responsible that you are fit and healthy enough to take part of our adventure trips.

13. Travel Insurance

  1. Purchasing a travel insurance covering the entire duration of the trip is mandatory for all our clients.
  2. Due to the hazardous nature of the tours, we strongly recommend our Customers to purchase a travel insurance that covers all personal requirements from insurance of damage or theft of the Customer’s personal effects to coverage of medical expenses, repatriation, and air ambulance in events of accidents or illness.
  3. We also recommend all our customers to purchase a flight cancellation insurance to cover any potential cancellations of the tours due to situations of lack of minimum participants required per tour (minimum 5) or cases of force majeure’, weather, local political conditions, man-made or natural disasters, entry or border difficulties, mechanical breakdowns, sickness or other unforeseen circumstances.
  4. We insist on sending us the details related to the purchased travel insurance no later than 15 days prior to start of the trip - a scanned copy of the insurance policy together with 24/7 emergency contact number and the details of the emergency contact person.
  5. If no proof of travel insurance is provided to the Company latest the day of departure, the Company reserves the right to cancel the booking of the Customer with no right to refund.

14. Flights

  1. Our trip does not include international or regional air travel. This allows for flexibility in arranging your own flights, such as using your air miles, arranging stopovers, flying business class, arriving early or leaving later.
  2. As flight tickets are not arranged by the Company, we take no responsibilities for any losses, inconveniences or damages that are results of your flights. Any consequences of canceled, missed or rescheduled international flights are the passenger's responsibility.

15. General restrictions

  1. The Customer is due to comply with all local country’s legislation, immigration policies and visa requirements and accepts that any contravention to these rules fall entirely under the Customer’s responsibility. In the event of such situations, the Company reserves the right to refuse to the specific Customer to leave the expedition, with no right for the Customer to obtain any refund.
  2. All participants are required to follow all local country’s regulations, traffic laws. In the event that a rider is not complying with the aforementioned laws, the Company reserves the right to exclude the client from the rest of the trip.
  3. Each participant is responsible for paying any traffic violations that he/she is responsible for.

16. Personal Effects

  1. The Company is not liable for any damaged, lost or stolen personal effects. This is applicable also to the situations where the Company’s personnel or the Company’s support vehicle carries the personal items.

17. Accidents

  1. The Company is not liable for any accidents that may occur during the trip. Based on this, you understand and agree that the Company’s personnel are not the guardians of your safety and cannot be held liable in any way for any occurrences that may result in the injury, death or damage to the Customer and property.

18. Motorcycle Insurance

  1. The company will take responsibility for damages to the motorbikes up to 300€. For more costly damages, the Customer will be liable for the first 3000€ deemed by the Company to be the Customer’s responsibility. However the damage caused due to riding it through not previously agreed itineraries is considered customer’s responsibility.

19. Customer responsibility when riding

  1. Riding under the influence of alcohol or other drugs is strictly prohibited.
  2. In case of riding the motorcycle under the influence of alcohol or other drugs, the Customer will take unlimited liability for any damages occurred. For such cases, the Company is not obliged to substitute the motorcycle for the remaining part of the journey.
  3. All riding privileges are suspended for riders who drive under the influence of alcohol.

20. Minimum riding requirements

  1. The Customers must have a valid motorcycle driving licence older than 2 years at the day the starting date of the trip.

21. Group Leader

  1. The Group Leader is the representative of the Company during the entire duration of the tour. The name of the Group Leader will be communicated to the group, the latest on the day of departure.
  2. The Customer is expected to follow all reasonable instructions and requests made by the group leader, knowing that the group leader always acts in the benefit of the group.
  3. If the behavior or any physical condition of any Customer comes to affect the comfort or enjoyment of the tour for any the other participants, the group leader reserves the right, on the behalf of the Company, to cancel the further participation to the expedition of the specific Customer and reserves the right to retain the entirety of the sum paid by the Customer.

22. Rates

  1. Expedition rates are based on tariffs and exchange rates in effect at the time writing and are subject to change prior to departure. Substantial changes in tariffs, exchange rates and the price of fuel, services and labor sometimes increase the cost of expedition arrangements significantly, and we reserve the right to alter our prices.

23. Complaints

  1. EWe are looking for continuously improving our services and keen on solving any complaints raised by our Customers.
  2. The Customers are entitled and strongly supported in raising immediately any complaints that they might have to the Group Leader. The Group Leader and the Company will do their best to resolve the complaints as they arise.
  3. In the event where the complaints cannot be solved in due time, the Customer is bound to make a complaint in writing and address it to the Company within the next 7 days since the completion of the expedition.
  4. Any Customer’s failure in following the above-mentioned procedure leaves solely at the Company’s discretion to pursue or not with settling the complaint within the terms and conditions of this Contract.

24. General Conditions of the current Contract

  1. This contract falls under the exclusive jurisdiction of the Romanian laws and are in compliance with the European Union regulations in the field. All parties involved accept the jurisdiction of the Romanian courts of Law to settle (if the case) any disputes that may arise related to the current Contract.
  2. Severability provision: If for any reason whatsoever, any term or condition of this agreement or the application thereof to any party or circumstance is, to any extent, invalid or unenforceable, all other terms and conditions of this Agreement and/or the application of such terms and conditions to the parties or circumstances shall not be affected thereby and shall be separately valid and enforceable to the fullest extent permitted by law.
